The FBI has not said why. But the decision came around the time she <a href=\"https:\/\/www.nytimes.com\/2025\/07\/10\/us\/politics\/fbi-polygraph-kash-patel.html\" target=\"_blank\" rel=\"noopener\">refused to endorse<\/a> what was reportedly a thinly sourced report accusing China of interfering in the 2020 US presidential election in favour of Joe Biden. <\/p>\n<p>At the Bureau, loyalty tests and polygraph checks have also <a href=\"https:\/\/www.nytimes.com\/2025\/07\/10\/us\/politics\/fbi-polygraph-kash-patel.html\" target=\"_blank\" rel=\"noopener\">allegedly become routine<\/a> as part of a crackdown on news leaks. When approached by the New York Times about the matter, the FBI declined to comment and cited \u201cpersonnel matters and internal deliberations\u201d.<\/p>\n<p>The situation does not seem to be much different at the CIA. In May, agency director John Ratcliffe ordered a review of the intelligence community\u2019s earlier conclusion that Russia had interfered in the 2016 presidential campaign on behalf of Donald Trump. The conclusion, <a href=\"https:\/\/www.msn.com\/en-us\/news\/politics\/cia-review-challenges-assessment-of-russian-meddling-in-the-2016-election\/ar-AA1HRg1I?ocid=BingNewsSerp\" target=\"_blank\" rel=\"noopener\">Ratcliffe contends<\/a>, was unwarranted and imposed by political pressure \u2013 a claim that <a href=\"https:\/\/www.spytalk.co\/p\/exclusive-top-former-cia-russia-report\" target=\"_blank\" rel=\"noopener\">has been rejected<\/a> by one of the report\u2019s leading authors. <\/p>\n<p>The intelligence community has reportedly also <a href=\"https:\/\/apnews.com\/article\/iran-trump-intelligence-assessment-cia-nuclear-distrust-13d39a9cd96ff4021e9be780bf5f8491\" target=\"_blank\" rel=\"noopener\">been under pressure<\/a> to substantiate Trump\u2019s claims that the recent military strikes on Iran had obliterated its nuclear sites. This is despite mixed evidence regarding the extent of their success. These examples suggest a growing politicisation of intelligence and national security in the US. <\/p>\n<p><a href=\"https:\/\/www.foreignaffairs.com\/united-states\/trump-breaking-american-intelligence\" target=\"_blank\" rel=\"noopener\">Researchers<\/a> and <a href=\"https:\/\/www.france24.com\/fr\/am%C3%A9riques\/20250712-fbi-kash-patel-ombre-edgar-hoover-espion-securite-trump-detecteur-mensonge-chine\" target=\"_blank\" rel=\"noopener\">observers<\/a> have highlighted the detrimental effect of this process. When intelligence is conducted by ideologues that are screened for loyalty, it often becomes more about pleasing the leader than collecting accurate information and preventing failure. <\/p>\n<p>Less attention has been paid to the permissive attitude of Congress. Many Republicans in Congress have taken an <a href=\"https:\/\/www.politico.com\/news\/2025\/06\/26\/trump-claims-iran-00429126\" target=\"_blank\" rel=\"noopener\">unquestioning attitude<\/a> toward the claims made by the president and other officials, allowing intelligence agencies to pursue Trump\u2019s agenda unimpeded. <\/p>\n<p>While Trump and Patel\u2019s focus on personal loyalty when it comes to intelligence is new, partisan influence in congressional oversight is not. This view was expressed by former CIA legal counsel, Walter Pforzheimer, during an interview in 1988. Reflecting on the early days of oversight, <a href=\"https:\/\/www.hoover.org\/research\/eyes-spies-congress-and-united-states-intelligence-community\" target=\"_blank\" rel=\"noopener\">he stated<\/a>: \u201cIt wasn\u2019t that we were attempting to hide anything. Our main problem was we couldn\u2019t get them [Congress] to sit still and listen.\u201d<\/p>\n<p>This quote isn\u2019t entirely true. In research from 2023, <a href=\"https:\/\/www.tandfonline.com\/doi\/pdf\/10.1080\/02684527.2023.2279317\" target=\"_blank\" rel=\"noopener\">I showed that<\/a> Congress was more involved than was generally believed. The US-backed 1954 coup in Guatemala, which deposed the democratically elected president, Jacobo \u00c1rbenz, is a case in point. Leading members of Congress were \u201cin the know\u201d and others pushed Dwight Eisenhower\u2019s administration to be even more aggressive.<\/p>\n<p>But Congress took on a more active role in intelligence matters in the 1970s. Following a series of public revelations about the CIA\u2019s behaviour, a select committee was established in 1975 <a href=\"https:\/\/www.senate.gov\/about\/powers-procedures\/investigations\/church-committee.htm\" target=\"_blank\" rel=\"noopener\">and exposed abuses<\/a> by intelligence agencies including the surveillance of US citizens, experiments with drugs and involvement in assassinations.<\/p>\n<p>In the wake of this, Congress established intelligence committees with oversight duties. The idea was that the CIA would present a document signed by the president to notify congressional committees of its intentions. <\/p>\n<p>However, the system ran into trouble in the 1980s, and partisanship and politicisation were part of the story. The Ronald Reagan administration\u2019s support for the <a href=\"https:\/\/www.britannica.com\/topic\/contra-Nicaraguan-counterrevolutionary\" target=\"_blank\" rel=\"noopener\">\u201ccontra\u201d<\/a> rebels in Nicaragua made intelligence a matter of severe partisan conflict.<\/p>\n<h2>Removing Nicaragua\u2019s government<\/h2>\n<p>When Reagan took office in 1981, one of the primary foreign policy priorities for his administration was removing the Sandinista National Liberation Front from power in Nicaragua. The administration saw the Sandinistas as a threat to the region and \u2013 in Reagan\u2019s <a href=\"https:\/\/www.jstor.org\/stable\/3791173?item_view=read_online&amp;seq=1\" target=\"_blank\" rel=\"noopener\">black-and-white thinking<\/a> \u2013 as puppets of Communist Moscow and Havana.<\/p>\n<p>The administration sought to convince Congress that its aims were limited. The aim, or so CIA director William Casey told the intelligence committees, was to obstruct the transfer of weapons from Nicaragua to neighbouring El Salvador. Another left-wing guerrilla movement, the Farabundo Mart\u00ed National Liberation Front, was threatening the US-supported government there.<\/p>\n<p>Initially, the policy received bipartisan support in Congress. The linchpin of this policy was the creation of an insurgent group in Nicaragua called the contras (<em>contrarevolucionarios<\/em>). The contras\u2019 stated goal of overthrowing the Sandinistas, which they ultimately failed to do, also contradicted the earlier Reagan administration\u2019s statements to Congress. <\/p>\n<p>Democrats in Congress pushed the leadership of intelligence committees to curtail the administration\u2019s activities. Edward Boland, chairman of the House Intelligence Committee, penned and helped to <a href=\"https:\/\/www.britannica.com\/topic\/Boland-Amendment\" target=\"_blank\" rel=\"noopener\">pass two amendments<\/a>. The first prohibited any US government support for the purpose of overthrowing the Nicaraguan government.<\/p>\n<p>When the administration found loopholes to circumvent this, Boland\u2019s second amendment prohibited any US funds from being spent in support of the contras. This amendment is generally understood as a first step towards the so-called <a href=\"https:\/\/www.britannica.com\/event\/Iran-Contra-Affair\" target=\"_blank\" rel=\"noopener\">Iran-Contra scandal<\/a>. <\/p>\n<p>The Reagan administration illegally funded the contras behind Congress\u2019s back by using the proceeds from secret arms sales to Iran \u2013 a state the US had been at loggerheads with since the 1979 Islamic revolution.<\/p>\n<p>The Boland amendments also helped make an intelligence and covert operations issue a matter of public debate and \u2013 more importantly \u2013 congressional votes. Republicans in Congress abandoned their oversight duties and followed the administration\u2019s guidelines. <\/p>\n<p>Votes on contra aid became an opportunity for partisan controversy, vitriolic attacks, accusations of betrayal and large-scale influence campaigns. Instead of oversight, a deep partisan divide materialised. <\/p>\n<h2>Counting on Congress? Think again<\/h2>\n<p>The role of Congress is to conduct oversight. It is the role of the governing administration to keep Congress informed of intelligence matters, particularly covert operations. History shows this has often been hard to achieve. <\/p>\n<p>Congress has been complacent, complicit and often too willing to follow the government\u2019s lead. In some cases, Congress has acted but primarily in the aftermath of major scandals or media revelations. This is <a href=\"https:\/\/www.oupcanada.com\/catalog\/9780190682712.html\" target=\"_blank\" rel=\"noopener\">called<\/a> \u201cfirefighting\u201d behaviour.<\/p>\n<p>But \u201cfirefighters\u201d seem to now be in short supply.
